It means that you will be given replacement of your wages in the event that you are injured while you are at work and that medical benefits will be forthcoming in order to assure that you can receive treatment for your injuries.</p>
<p>While the various plans of medical benefits are different according to the state, and also dependent upon what type of work you do in some cases, your right to sue your employer may also be bartered away in return for your workers compensation rights, although this is not strictly true. </p>
<p>Workers comp of New Jersey makes provisions for the injured New Jersey worker to be paid a weekly stipend in place of the wages that he or she might have earned had they not been injured. It will pay your wages as well as medical bills while you are away from work. It will also pay benefits to the dependents of workers who are injured or killed while they were employed.</p>
<p>Workers comp does not always pay and in fact, in some cases, the benefits that you are entitled to may be denied to you and your rights must be asserted in a court case. These New Jersey workers comp cases are becoming slightly more numerous as companies attempt to lower payments and to assert their own rights, particularly in an economy which has suffered some recession in recent months.</p>

<p>Just as you&#8217;re aware of Facebook and other social media websites, so too are the attorneys and staff that are working on the side of the insurance company who may not believe that your workers compensation claim is legitimate. It isn&#8217;t an inherent right, but has to be determined and the rules for determination are often circuitous. Real effort on your part may be required to obtain the award. <p>Workers compensation is an aid to workers who have been injured, but it&#8217;s not always an easily navigable road to take. In most states the workers compensation is limited for the injuries which are work related. Workers compensation is the sole action the worker may take, unless the employer knew in advance of existing circumstances where harm might be caused, or that the employer actually intended to cause harm to the worker. </p>

The answer to that question is no, they may not deny you treatment, but you are the one who is responsible for making sure that you get it in some cases.<span id="more-63"></span></p>
<p>Your employer is a partner in your financial future, but sometimes when you&#8217;re injured at work that may change. Very often, sometimes without intent, employers tend to look down on employees who are injured at work and the employee will feel somewhat less likely to report an injury or ever to seek treatment.</p>
<p>Failing to report an injury means that you are not qualified to receive any type of treatment for the injury under the law and that your employer is not necessarily constrained to offer you any type of remuneration after the fact, even if you find out later that your injury is more serious than was originally thought.</p>
<p>If you report your injury to your employer immediately you have the best chance of receiving your workers compensation without any real problems so it is encouraged that you report your injury and seek treatment within 24 hours and it is the law that you must report it within 7 days if you are to achieve any type of treatment or compensation for it.</p>
<p>Your responsibility is to notify your employer as rapidly as possible after your accident and to make sure that it is documented at work so that everyone knows that you received your injury in the workplace. This makes for granting you workers compensation far more easily accomplished.</p>
<p>Your employer has the responsibility to provide you with medical treatment if you request it immediately following the injury. If your injury is an emergency, then you can be sent to an emergency room for treatment. If the accident is not emergent in nature on site treatment may be provided by a nurse or an EMT or Paramedic, with follow-up treatment at a physician or hospital.</p>
<p>The worker has the right to prompt medical treatment and the employer has the responsibility to provide it. It may be in an emergency room immediately after the accident, and then the employer may be notified if it is an emergency injury.</p>
<p>If the injury is not emergent or life threatening, the employee has to notify the employer first of the injury and then seek medical care after speaking to the supervisor or employer.</p>
<p>The competent employer will not only offer medical care for their employee but will go with them to the medical facility in order that they know best what the physicians say is the prognosis and the diagnosis, as well as to know when the employee will be permitted to return to work.</p>
<p>Your employer does have the obligation in most states to see to the treatment of your injury and if the injury is of a serious nature, it is mandated that treatment take place immediately.</p>
<p>While your employer may offer you the physician who ordinarily treats the company employees you do have the right to request another doctor. In some states they are not obligated to offer that, however some permit it if you have requested to not use the company physician in advance, well before your injury has taken place.</p>

<p>A lot of people who are injured on the job may wonder if they have  the right to collect workers compensation. Some will not even report the  injury, believing that if they are at fault in the injury, they do not  have the right to collect for their injured status.<span id="more-54"></span></p>
<p>Depending upon  what state you work in, those statutes can change, but for the most  part, anyone who is injured on the job, with just a few exceptions, has  the right to collect workers compensation for their injury, and at least  to be covered prior to coming back to work.</p>
<p>In most cases when  you are injured while working for an employer, regardless of who is at  fault in the injury, you have the right to medical treatment and you do  have the right to some type of compensation.</p>
<p>There are some  exceptions to this rule of being able to have the compensation though.  In some states if you are an independent contractor, even if you are  working in the facility as part of a team, if you are injured on the  job, you are not eligible for compensation from the company that you are  working at, but you are eligible for the compensation for your injury  from the company that you are employed for. For example if your  electrical company is working inside a computer shop, if you are shocked  at the shop, regardless of who is at fault, you can get immediate and  lifesaving treatment, but you may not try to claim workers compensation  from the computer store.</p>
<p>You are however, eligible to claim  workers compensation from the electrical service that you work for. This  means that someone will be paying your compensatory wages and your  medical expenses but it will not be the company in which you were  working.</p>
<p>Another group which is not able to use the workers  compensation for a given company will be the independent contractor or  temp worker. IF you are working as a temporary service or are booked in  for what you do as a consultant or an independent contractor, you are  not able to collect workers compensation even if you are injured on the  job. This does of course depend on the contract under which you are  working.</p>
<p>In addition, this does not mean that you should not  report an injury. If you do not report within a reasonable amount of  time, usually seven days, even if you may by some chance be able to get  your compensation, you are going to be denied it.</p>
<p>Likewise, in  most states, the compensation for injured workers will mean that you may  not sue the company who is paying you the compensation. You will want  to report any injury and to seek out treatment as rapidly as possible  when you are injured and you may wish to seek out legal advice to find  out the best way to proceed if you are injured at work or in a job in  which you are a consultant.</p>

<p>The laws of every state differ when it comes to workers injuries and the compensation of the worker for injuries that they may have suffered on a job. In fact, most of them are rapidly changing with regard to what may and what may not be covered, as well as when the coverage will take effect for every state.</p>
<p>As with any other type of law, workers compensation laws in New Jersey, and elsewhere in the United States can be complex. <p>There is a seven day waiting period prior to your compensation being active, however that is not the case for first aid workers, rescue workers, firefighters, or fire marshals, and other emergency workers. These facts are true as well for ambulance drivers and rescue workers or firefighters even if they are part of a squad that is volunteer in nature.</p>
<p>There is a twenty percent coverage of attorney fees available to those in New Jersey and if your disability goes past the seven day period, then your compensatory pay is retroactive to the date of injury.</p>
